When couples divorce or separate there are many complications that are attached however, one of the main issues is that of finance. The family home has to be considered for example, how will the rent or mortgage be paid? The possibility of saving the home for the sake of their children, or if the house has to be sold how will it be divided?

Another complicated issue is that of how the savings and investments are to be dealt with and also how other assets such as cars, possessions etc. will be divided.

In court an application may be made to the court for orders including:

  • Property adjustment – which determines a party’s interest in a property.
  • Lump sum order – awarding a sum of money to one partner
  • Maintenance – maintenance is paid to one partner by the other.
  • Pensions – the court must be sure that each party has honestly given all of their financial details.
  • Child maintenance – this is dealt with by the Child Support Agency. It has the power to make a parent pay maintenance for the children.

In both separation and divorce, the legal process allows the parties to agree all aspects of the marriage breakdown:
